NUTELLA, the maker of the popular hazelnut-flavoured spread has agreed to a US$3-million settlement to end four lawsuits filed in the United States that claimed that Nutella engaged in misleading marketing that portray its product as a healthy part of breakfast.

According to sources, the four mothers were unpleased to find out that the spread packed twice as much sugar as similar amount of jam or syrup. The women alleged they and other consumers were duped by Nutella television ads and websites, which used words such as ‘nutritious’ and ‘healthy’. Said the plaintiff in court documents, Nutella contains little protein and consists primarily of sugar and modified palm oil.

The settlement will be reviewed before approval at court hearings in California and New Jersey in July. Eligible consumers can submit a claim for US$4 per jar purchase, up to a maximum of US$20.

Ferrero USA, Inc., the manufacturer of Nutella, has agreed to change its labelling and advertising campaigns.
